Terms of Use

These terms are an agreement between you and Wemma Technologies Inc., an Ontario corporation (Ontario Corporation Number 1001710538), trading as BuzzBaby ("BuzzBaby", "we", "us") covering your use of the BuzzBaby app and this website. By using BuzzBaby you agree to them.
Who can use BuzzBaby
You must be at least 19 and be the parent or legal guardian of any child you add, or have that person's permission. You're responsible for what happens under your account.
BuzzBaby is not medical advice
BuzzBaby offers play and learning suggestions. It is not a diagnostic, screening, therapeutic or medical service, it does not assess whether a child's development is typical, and it is not a substitute for advice from a doctor, health visitor, therapist or educator. Never delay seeking professional advice because of something you read in BuzzBaby.
What you record in the Tracker
BuzzBaby lets you keep a record of your child's feeding, sleep, diapers and growth. That record is yours. You choose what to put in it, and you can delete it at any time.
It is not a medical record and we are not a healthcare provider. We store it so you can see it and keep it, not to assess your child. BuzzBaby does not analyse those entries, does not tell you whether any of it is normal, and does not alert you to anything. If something about your child's feeding, sleep or growth worries you, take it to your doctor or public health nurse, who can look at your child rather than at a number.

Play safely
BuzzBaby suggests activities from what it can see in a photograph. It cannot tell whether an object is clean, whether it is broken, whether it is the right size for your child, or whether today is a day your child can manage it. You can. Every activity is a suggestion, and the decision to do it is always yours.
By using BuzzBaby you agree that you will:
- Stay with your child while they play, and stay within arm's reach for anything involving water, height or climbing.
- Check every object before you hand it over. Look for small or loose parts, sharp edges, splinters, cracks and anything already broken.
- Keep small objects away from children under three. A useful test is that if an item fits inside a toilet roll tube, a small child can choke on it. That includes coins, marbles, buttons, beads, bottle caps, and small hard foods such as whole grapes, nuts, popcorn and hard sweets.
- Treat a swallowed button battery or magnet as an emergency. If either is swallowed it can cause severe internal injury within hours. Go to emergency immediately rather than waiting for symptoms.
- Never leave a child alone near water, not for a moment and not in a few centimetres of it. Empty baths, basins, buckets and paddling pools as soon as you have finished.
- Keep cords, strings, ribbons, blind pulls and plastic bags out of reach. These are strangulation and suffocation risks, and they are the reason we never suggest an activity that uses them.
- Never pull your child up by their hands, arms or wrists. A small child's elbow dislocates easily. Lift under the arms, or let them do the pulling.
- Check for allergies before any activity involving food, and do not use food as a play material with a child who is not yet eating solids.
- Stop if your child is upset, tired, frustrated or simply not enjoying it. No activity in BuzzBaby is worth pushing through.
If your child has a medical condition, an allergy, a physical limitation or a developmental difference, talk to your doctor about what is suitable before following suggestions in BuzzBaby. We do not know any of that about your child, and the app does not ask.
You remain responsible for supervising your child at all times. Nothing in BuzzBaby replaces your own judgement about your own child in your own home.
Subscriptions and payment
BuzzBaby is free to use. The tracker, your child's milestone portrait, the reading library for the ages your child has reached, and a photo scan each day do not cost anything and are not time limited. You can use BuzzBaby this way for as long as you like without ever paying us.
Plus is the optional paid tier. It adds things like unlimited scans, reading ahead in the library, activity history, and room for more children and more caregivers. It is an auto-renewing subscription, sold monthly, quarterly or yearly. Some plans are offered with a free trial and some are not; where a trial applies, its length is shown to you in the App Store or Google Play before it starts.
The price and the billing period are shown before you are asked to pay anything, and prices differ by country because Apple and Google set them regionally.
Where you buy it. Subscriptions are sold through Apple's App Store or Google Play, and those companies take the payment, not us. We never receive or store your card details. Your purchase is also subject to Apple's or Google's own terms.
How renewal works. A Plus subscription renews automatically at the end of each billing period, at the price shown when you bought it, until you cancel. If your plan came with a free trial and you do not cancel before the trial ends, it becomes a paid subscription. Cancelling Plus does not close your account or take away the free tier.
How to cancel. You cancel in your own device settings, not by writing to us. On iPhone that is under Settings › your name › Subscriptions, and on Android in the Play Store under Payments and subscriptions. Cancelling stops the next charge; you keep access until the period you have already paid for ends.
Refunds. Because Apple and Google take the payment, refunds are theirs to give, under their published policies. If something has gone wrong, write to us at info@buzzbaby.org and we will help you take it up with them.
Price changes. If we change the price of a subscription, the new price does not apply to you until you are told about it in the way Apple or Google requires, and you may cancel rather than accept it.
Your content
Photos, notes and information you enter remain yours. You give us permission to use them only to provide BuzzBaby to you, as described in our Privacy Policy.
Our content
The activities, text, illustrations, software and the BuzzBaby name are ours or our licensors'. You may use them for your own family's personal, non-commercial use. Please don't copy, resell or republish them.
Acceptable use
Don't misuse BuzzBaby. No reverse engineering, scraping, reselling access, uploading unlawful content, or interfering with the service or other people's use of it.
Availability
We work hard to keep BuzzBaby running, but we can't promise it will always be available or error-free, and we may change or discontinue features.
Liability
BuzzBaby is provided as it is. To the extent the law allows, we do not promise any of the following, because none of them is something we can guarantee:
- That the camera reads a room correctly. It can miss an object that is there, and it can name an object that is not.
- That an activity is the right level on a given day. We work from what you have told us about your child, and children change week to week and hour to hour.
- That what the app shows about your child's skills is accurate. It is built from your own answers, not from an assessment, so it is only ever as right as the answers.
- That the reading library fits your situation. It is general information written for many families, not advice about yours, and it cannot account for anything specific to your child.
- That the app is always available. Scanning needs a connection and depends on a service we do not run, so it can be slow or unavailable.
- That the content is free of errors. Everything is reviewed, but we write a great deal of it. We correct mistakes as soon as we find them, and faster when you tell us at info@buzzbaby.org.
There are things we do not limit, and would not want to. Nothing in these terms excludes or limits our liability for:
- Death or personal injury caused by our negligence.
- Fraud, or telling you something untrue to get you to buy.
- Anything else the law does not let us exclude.
We put that first, and in plain words, because BuzzBaby suggests physical play with small children.
Beyond that, and only as far as the law allows, here is what we are not responsible for.
- Knock-on losses. If the app is down on the evening you had set aside, if you bought something because of an activity and wished you had not, or if a problem with BuzzBaby cost you time or work, those are not losses we can carry.
- The decisions only you can make. Whether to do an activity at all, whether the cup or the blocks in your home are clean and safe and the right size, whether your child is having a day for it, and whether to stay in the room. You know all of that. The app knows none of it.
- Other companies' services breaking. BuzzBaby needs the App Store and Google Play to deliver the app and handle your payment, your own internet connection to work at all, and an outside AI service to read your photos. When one of those is slow or down, BuzzBaby is affected too, and there is nothing we can do about it from our end.
- More than a set amount. For everything arising in any twelve month period, the most we can owe you is whichever is greater: what you paid us for BuzzBaby in that period, or CAD $50.
None of this takes away your rights as a consumer. Canadian consumer protection law gives you rights that a company cannot ask you to give up, and this section does not try to. In Ontario, the Consumer Protection Act, 2002 says that an attempt to make you waive those rights simply does not work. Quebec's Consumer Protection Act does the same, and the other provinces have their own. So if anything above runs up against a right you have, your right wins, and the rest of this section still applies as written.
Ending your account
You can stop using BuzzBaby and close your account at any time. We may suspend or close an account that breaks these terms.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and disputes will be handled in the courts of Ontario. Nothing here takes away consumer-protection rights you have under the law where you live.
